Tern's updated Terms of Service take effect October 22, 2026.

Full Terms: tern.travel/terms-of-service.

Privacy Policy: tern.travel/privacy. DPA: tern.travel/dpa. Hotel Booking Terms: tern.travel/booking_terms_of_service.

Why am I being asked to accept new Terms?

We've updated our Terms to reflect how Tern works today, including hotel bookings, payments and AI features. Everyone accepts once to keep using Tern. Tern records which version you accepted and when. (Sections 4.1, 4.5)

What if I don't agree?

If a change materially affects you, you can close your account and get a pro rata refund of any prepaid subscription fees. (Section 4.4)

How will I hear about future changes?

By email or in the app, with the effective date. Material changes take effect at least 10 days after notice. (Section 4.4)

Can I use an AI agent or browser extension (for example, Claude in Chrome) in my account?

Yes. No written permission is needed. The agent acts as you, so you're responsible for everything it does and can see. It can't be used to scrape or bulk-extract data. Tern may limit or block automated activity that looks risky. (Section 5.5)

Can I share my login with an assistant or teammate?

No. Each person needs their own account and seat. Giving an AI agent access to your session is allowed under Section 5.5, and it counts as you. (Sections 5.3, 8.3)

Who owns my content and client data?

You do. Tern only uses it to run, support and improve the service, and acts as your data processor. We don't sell it. (Sections 7.1 to 7.2, 11)

Does Tern use my data for AI or share it with suppliers?

Tern may create de-identified, aggregated data that can't be linked to you or any traveler. It's used to improve the service and for analysis, including analysis shared with suppliers. Identifiable client data is never shared that way. (Section 11.4)

Are AI features accurate?

AI output can be incomplete or wrong, so review anything before sending it to a traveler. AI property descriptions are human-reviewed. Tern doesn't use AI to generate property photos. (Section 7.5)

Can I get a refund on my subscription?

Generally no refund for unused time. Exceptions: you reject a material Terms change (Section 4.4), or Tern ends your access on notice for a reason other than breach (Section 21). Cancel any time; access runs to the end of the period. (Sections 8.1, 21)

Will my price change?

Only at renewal, with at least 30 days' notice and the option to cancel first. Annual plans get a reminder before renewal. (Sections 8.1 to 8.2)

I'm leaving my agency. What happens to my account and clients?

Your login and profile are yours, and you can keep them with your own subscription. Access to client information depends on who controls it and your agreement with the agency. If you and the agency disagree, Tern may temporarily restrict the disputed data until you resolve it. (Section 8.4)

Who gets the commission on a booking?

The agency the booking is attributed to when it's made. If another agency disputes it in writing, Tern may hold that commission for up to 30 days. (Sections 2.2, 8.8)

Can I use payments or invoicing for traveler deposits?

Only if Airwallex has underwritten your account for travel funds and told you so in writing. Standard accounts are for your own business receipts (service, marketing and membership fees). If you're not sure, ask before processing. (Section 9.6)

Who processes payments now?

Airwallex, a licensed money transmitter, handles payment services in invoicing and payouts. Stripe still bills your Tern subscription. (Sections 9.2, 9.13)

Can Tern deduct money from my commission?

Yes, but only for amounts you owe Tern under the Terms, like chargebacks. Never from traveler funds. Tern tells you what was deducted and why. (Section 19)

When Tern sells a hotel, who's responsible?

For Tern hotel inventory, Tern is the seller and merchant of record, and the Booking Terms apply. Your client agrees to them when they authorize payment for a Hotels by Tern hotel. For other bookings, the supplier's own terms apply. (Sections 3.1 to 3.2, 10)

Can I display Tern's seller of travel number?

No. Tern's registrations only cover Tern's own sales. Use your own registration numbers. (Section 8.7)

I'm in Quebec. Can I use Tern?

Advisors and agencies based in Quebec can't use Tern at this time. (Sections 5.1, 9.6)

How are disputes handled?

Either side sends written notice and tries to resolve it for 60 days first. Disputes with advisors and agencies go to Delaware courts. Disputes with travelers go to individual arbitration, and travelers can opt out within 30 days. (Section 20)
